Preamble

These General Terms and Conditions (GTC) govern the contractual relationships between FutureHorizons UG (limited liability) (hereinafter "Provider" or "FutureHorizons") and its customers (hereinafter "Customer" or "Participant") for all services offered in accordance with German law, in particular the German Civil Code (BGB), the Distance Learning Protection Act (FernUSG) and the Trade Regulation Act (GewO).

§ 1 Scope and Subject Matter of Contract

1.1 Scope of Application

These General Terms and Conditions apply to all contracts between FutureHorizons UG and customers for the provision of the following services according to the commercial register entry dated October 28, 2025:

  • Online German Courses: German courses for all proficiency levels (A1.1 to C1.2) with issuance of certificates of participation
  • Consulting Services: Consulting for international students, professionals and further education participants
  • Application Support: Support with application processes in Germany
  • Translation Services: Professional translation of documents
  • Job Placement: Placement of international professionals with German employers

1.2 Consumers and Entrepreneurs

These GTC apply to both consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB. Where special provisions apply to consumers, these are marked separately.

1.3 Deviating Conditions

Deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract unless their validity is expressly agreed to in writing.

Important Notice according to Trade Regulation Act

FutureHorizons UG is properly registered with the competent trade office and is subject to the provisions of the Trade Regulation Act (GewO), in particular § 14 GewO (notification obligation). The business activities comply with the requirements of the commercial register entry and official permits.

§ 2 Contract Formation

2.1 Contract Formation for Online Services

The contract is concluded in the following steps:

  • Step 1: The customer selects the desired service (e.g. German course) on our website
  • Step 2: The customer enters their data in the registration form
  • Step 3: The customer checks their entries and submits the form (binding order)
  • Step 4: The customer receives an automatic confirmation of receipt by email (not yet acceptance)
  • Step 5: FutureHorizons accepts the offer by sending a registration confirmation by email

The contract is only concluded upon receipt of the registration confirmation (Step 5).

2.2 Contract Formation for Individual Services

For individual services (consulting, translations, job placement), the contract is concluded by:

  • Written offer from FutureHorizons
  • Written or electronic acceptance by the customer
  • Or by order confirmation from FutureHorizons after customer inquiry

2.3 Contract Language and Contract Text Storage

The contract language is German. The contract text is stored by us after conclusion of the contract and sent to the customer by email.

§ 3 Right of Withdrawal for Consumers

Withdrawal Instructions according to § 312g BGB in conjunction with § 355 BGB

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (FutureHorizons UG (limited liability), Alban-Berg-Straße 11, 85057 Ingolstadt, Email: info@futurehorizons.de, Phone: +49 157 38168104) by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you immediately and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract.

Special Notes according to § 356 para. 4 and 5 BGB

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount that corresponds to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

Early Expiry of the Right of Withdrawal

The right of withdrawal expires in the case of a contract for the provision of services if the entrepreneur has completely provided the service and only began to perform the service after the consumer has given his express consent and at the same time confirmed his knowledge that he will lose his right of withdrawal upon complete fulfillment of the contract by the entrepreneur.

§ 4 Prices and Payment Terms

4.1 Prices

All prices quoted are final prices in euros and include the statutory value added tax (currently 19% or 7% for reduced-rate services according to § 12 UStG), unless expressly stated otherwise.

4.2 Payment Methods

The following payment methods are accepted:

  • Bank transfer (advance payment)
  • SEPA direct debit mandate (for installment payments)
  • PayPal (possibly with additional fees)
  • Other by individual agreement

4.3 Payment Terms for German Courses

The following payment modalities apply to online German courses:

  • Full payment: Payment of the entire course amount no later than 7 days before the start of the course
  • Installment payment: Possible by individual agreement
    • First installment: 50% due before the start of the course
    • Second installment: 50% at the latest by the middle of the course

Participation in the course requires timely payment.

4.4 Payment Default

In case of payment default, the statutory provisions according to §§ 286, 288 BGB apply.

§ 5 Service Provision: Online German Courses

5.1 Course Scope and Duration

The online German courses include the following services:

  • Teaching time: 20 teaching units (TU) of 45 minutes each per week
  • Course duration: 8 weeks per proficiency level
  • Teaching format: Live online teaching via Zoom or comparable platform
  • Course materials: Digital learning materials and worksheets

5.2 Proficiency Levels

The courses are based on proficiency levels A1.1 to C1.2.

5.3 Minimum Number of Participants

The implementation of a course requires a minimum number of 3 participants.

5.4 Certificates of Participation

Participants receive a certificate of participation after completion of the course if the following requirements are met:

  • Minimum attendance of 80% of the teaching units
  • Regular participation in learning progress assessments
  • Full payment of course fees

Important Notice regarding Certificates of Participation

The certificates of participation issued by FutureHorizons are not official language certificates in the sense of telc, TestDaF, Goethe-Institut or similar examination institutions. They serve exclusively as proof of course participation and the language level achieved according to internal assessment.

§ 6 Additional Services

6.1 Consulting Services

For consulting services for international students, professionals and further education participants, the following applies:

  • The scope of services is determined by the individual offer
  • Consultation appointments are conducted by prior arrangement
  • Billing is done by hour or as a flat rate

6.2 Translation Services

For translation orders, the following applies:

  • Prices are calculated according to word count, degree of difficulty or as a flat rate
  • Delivery deadlines are individually agreed upon
  • The customer provides all necessary source documents in a timely manner

6.3 Job Placement

For the placement of international professionals with German employers, the following applies:

  • Placement is based on success or by individual agreement
  • A placement fee is only due upon successful placement
  • The customer undertakes to provide truthful information on all relevant data

§ 7 Withdrawal and Cancellation

7.1 Cancellation by the Customer

After expiry of the withdrawal period, the following cancellation fees apply to German courses:

  • Up to 14 days before start of course: Free cancellation
  • 13 to 7 days before start of course: Cancellation fee of 30% of the course fee
  • 6 to 3 days before start of course: Cancellation fee of 50% of the course fee
  • Less than 3 days before start of course: Cancellation fee of 80% of the course fee
  • After start of course: No refund

7.2 Withdrawal by FutureHorizons

FutureHorizons is entitled to withdraw from the contract if:

  • The minimum number of participants is not reached
  • The instructor is unable to attend for an important reason and no substitute is available
  • Technical problems make implementation impossible

§ 8 Liability and Warranty

8.1 Limitation of Liability

FutureHorizons is fully liable for damages resulting from injury to life, body or health. Otherwise, liability is limited to intent and gross negligence.

8.2 No Guarantee for Learning Success

FutureHorizons does not guarantee any specific learning success. Learning success depends significantly on the participant's commitment and cooperation.

8.3 Technical Malfunctions

FutureHorizons assumes no liability for technical malfunctions on the customer's side (internet, hardware, software).

§ 9 Data Protection

9.1 Validity of the Privacy Policy

The collection, processing and use of personal data is carried out in compliance with the General Data Protection Regulation (GDPR). For details, please refer to our separate privacy policy.

9.2 Data Processing for Contract Fulfillment

To carry out the contracts, we process personal data on the basis of Art. 6 para. 1 lit. b GDPR.

§ 10 Final Provisions

10.1 Applicable Law

The law of the Federal Republic of Germany applies to all legal relationships between FutureHorizons and the customer.

10.2 Place of Jurisdiction

For disputes arising from this contract, if the customer is a merchant, the place of business of FutureHorizons (Ingolstadt) shall have jurisdiction.

10.3 Severability Clause

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
